This is the last Will and Testament of me Edward Holdsworth late a Member of Magdalen College in the University of Oxford Master of Arts made the fifth day of October in the Year of our Lord Christ one thousand seven hundred and forty five in manner following that is to say Whereas my brother Winch Holdsworth of Chalfont Saint Peters in the County of Bucks doctor of Divinity hath sometime since conveyed or otherwise settled my deed sundry Lands Tenements and Hereditaments situated and being in the parish of Bray in the County of Berks or else where commonly called or known by the Name of Baldwins To hold for me my Heirs and Assigns after the decease of him the said Winch Holdsworth Now I do hereby give and devise the same Lands Tenements and Hereditaments called Baldwins or by what or other Name or Names the same have been or may or shall be called unto the now Wife of my said brother Winch Holdsworth in case she shall survive him To hold to her and her Assigns for and during the form of her natural Life and from and after the deceases of them the said Winch Holdsworth and my now Sister in Law his said Wife I give and devise all and singular the said Lands Tenements and the Inheritance and expectancy thereof unto my beloved Brother the Reverend Mr Henry Holdsworth Vicar of Dartmouth in the County of Devon his heirs and Assigns forever Also I give and devise unto the said Henry Holdsworth his Heirs and Assigns forever all other my Lands Tenements and Hereditaments whatsoever and wheresoever situate and being within the Realm of England Also I give and bequeath unto my said Brother Doctor Winch Holdsworth the sum of twenty pounds and I also give him the use of my pictures which are in his possession during his Life Also I give and bequeath to my said Sister in Law the now Wife of the said Doctor Winch Holdsworth the sum of twenty pounds Also I give and bequeath to the children of the said Richard Holdsworth and his now Wife and the survivors and survivor of them which shall be living at my death the sum of two hundred pounds to be disposed of for their his or her Benefit as my Executor herein after named shall think fit Also I give to my Heirs the Daughters of John and Ann Mason and the Survivors and Survivor of them who shall be living at my decease the Sum of two hundred pounds to be divided amongst them or disposed for their his or her Benefit at the sole Discretion of my said Executor allowing nevertheless to my God Daughter one of the said children in case she Page 2 shall survive me a double share Also I give my Brother in Law the Reverend Mr Downes the sum of twenty pounds Also I hereby direct that my Executor herein after named shall place out at Interest or in the publish funds at his Discretion the sum of eight hundreed pounds to the Intent that my Sister Philadelphia Downes shall have the use and produce thereof during her Life and after her Decease my Will is that the said eight hundred pounds shall be divided between her Daughters in manner following that is to say five hundred pounds to my Neice Elizabeth Downes and three hundred pounds to my Neice Philadelphia Downes and in case it should so happen that any Match be proposed for either of my said Heirs Downes which shall be approved of by their said Father and Mother or the survivor of them with the consent of my said Executor then my desire is that the aforesaid sum of five hundred pounds and three hundred pounds be respectively paid to them or to their husbands upon Condition that the Interest or Income of the same after the rate of four pounds for a hundred for a year be secured to their said Mother my sister Philadelphia Downes during her Life as aforesaid and in case either of my said Heirs dyes before she is intitled to such respective Legacy them my desire is that the whole should go to the Survivor of them subject to the payment of Interest or produce to the said Philadelphia Downes during her Life as aforesaid Also I give to my NephewRobert Downes fellow of Magdalen College aforesaid the sum of one hundred pounds to be employed in fitting up chambers for him in the New Buildings there Also I give to my Godson William Downes the sum of one hundred pounds to be employed for his Education in such manner and at such times and in such proportion as my said Executor shall judge most for his Advantage before he arrives at the Age of twenty one years Also I give to my Brother in Law Joseph Taylor the sum of ten pounds and my Will is that my said Executor shall place the sum of two hundred pounds out at Interest or in the publick funds to the Intent the same Interest or Annual Income shall be paid to and for the use of my Sister Mary Ann Taylor during her Life and after the decease of my Sister Mary Ann Taylor my Will is that the said Sum of two hundred pounds shall be divided amongst her children allowing to my Godson one of the said children in case he shall be living at my death a double share Also I give to my Sister in Law the wife of my Brother Henry Holdsworth twenty pounds Also I give to Magdalen College in Oxford the sum of one hundred pounds to be expended in and about the New Buildings there Also I give to my dear friend Charles Jennens of Queen Square London Esquire if living at the time of my decease my interleaved Virgils with all my papers relating thereto and my pictures which now are in his custody except that of James Herbert Esquire which Page 3 I desire might be returned to that family and whatsover remains after payment of my debts (if any) funeral expenses and Legacies (whether Bonds Goods Money or any other personal estate whatsoever I give to my said Brother Henry Holdsworth to and for his own proper use and the publick stock and Annuitys below par or my nonpayment of Money lent on any Securities whatsoever my Will is that all my Legatees herein before named shall bear a proportionable share in the deficiencies so that the Loss might not fall wholly on my Executor Lastly I make constitute and appoint my said Brother Henry Holdsworth sole Executor of this my last Will and Testatment hereby revoking all and every former Will and Wills by me at any time heretofore made and declared In Witness whereof I have hereunto set my Hand and Seal the day and Year above written Edwd Holdsworth Signed Sealed published and declared as and for the Last Will and Testament of Edward Holdsworth the Testator in the presence of us who have subscribed our Names as Witnesses thereto at his Request and in his presence and in the presence of each other Wm Jeanes of Shroton, Wm Grundsy Clerk to Mr Wm Jeanes, James Shayle of Shroton This Will was proved at London the nineteenth day of February in the Year of our Lord one thousand seven hundred and forty six before the Worshipful Robert Jenner Doctor of Laws and Surrogate of the right Worshipful John Bettesworth also Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oath of the Reverend Henry Holdsworth Clerk Master of Arts the Brother of the deceased and sole Executor in the said Will named to whom administration was granted of all and singular the Goods Chattels and Credits of the said deceased being first sworn duly to administer |
