In the Name of God Amen I Mary Gibbons of Saint Chads Row Battle Bridge in the Parish of Saint Pancras in the County of Middlesex Widow and Executrix and sole Devisee named in the last Will and Testament of Thomas Gibbons late of Saint Chads Row aforesaid Esquire Deceased being of sound mind memory and understanding do make this my last Will and Testament in manner and form following (that is to say) first and principally I recommend my soul to Almighty God hoping for a Blessed Resurrection through the Merits of my Blessed Redeemer Jesus Christ And I do direct my Executors hereinafter mentioned decently to Inter my Body in the Church Yard of Saint Mary Islington in the County of Middlesex as near to the Bodies of my late Father and Mother in Law Thomas and Ann Gibbons as conveniently may be And as to my worldly Estate and Effects which it has pleased God to bestow on me I give devise and bequeath in manner following that is to say Whereas by the last Will and Testament of my said Father in Law Thomas Gibbons late of the Parish of Saint Pancras in the said County of Middlesex Esquire deceased the said Thomas Gibbons by his said Will did (amongst other things) gave to Israel Gibbons and Guy Earl Warwick his Nephews one hundred pounds each to be paid to them as therein described which said sum of one hundred pounds each has since been paid Also he gave to each of the children of the said Israel Gibbons namely Hannah Gibbons Ann Gibbons Mary Gibbons and Catherine Gibbons fifty pounds each to be paid to them in manner therein mentioned which said sum of fifty pounds each to Hannah Gibbons now Hannah Oakman and to Ann Gibbons now Ann Huttly hath since been paid And also he gave and bequeathed unto Thomas Warwick and John Warwick to them and the Survivors of them one hundred pounds each when they attain the Age of twenty two years Also he gave to his Nephew Thomas Gibbons son of Lewis Gibbons three hundred pounds when he attains the Age of twenty two years and his Board Cloathing and Education until he attains that Age to be paid out of his Freehold Estates under the direction of his Son or his Executors And also that he should be put Apprentice at the expense of his said Son and to be Cloathed by him and his Executors during such Apprenticeship And also by his said Will he subjected his said Freehold Estates to the payment of one thousand pounds after the decease of his said Son in manner following (that is to say) To the said Israel Gibbons Guy Earl Warwick and their before mentioned Children and his said Nephew the said Thomas Gibbons Son of the said Lewis Gibbons or the Survivors of them share and share alike (that is to say) one half of the said one thousand pounds to be paid one year after the decease of his said Son and the other half of the said one thousand pound to paid two years after the decease of his said Son and by his said Will appoint his said Son Thomas Gibbons sole Executor of his said Will who duly proved the same in the Prerogative Court of the Archbishop of Canterbury and took upon himself the burthen and Page 2 execution thereof and there now remains unpaid of the said Legacies so devised by the said Thomas Gibbons as aforesaid the sum of fifty pounds to the said Mary Gibbons and the sum of fifty pounds to the said Catherine Gibbons and the said sums of one hundred pounds and one hundred pound each given to the said Thomas Warwick and John Warwick and the said sum of three hundred pounds so devised to his said Nephew Thomas Gibbons and the said sum of one thousand pounds contingent Legacies as aforesaid making together the sum of one thousand six hundred pounds And whereas I stand possessed of the following Freehold Copyhold and Leasehold Estates that is to say all that my Freehold Messuage or Tenement situate in Little Turnstile Holborn And also all that my Freehold Messuage or Tenement situate in Princes Street New Turnstile Holborn And also one other Freehold Messuage or Tenement Situate in Cursitor Street Chancery Lane Also all that other Messuage or Tenement situate opposite to Middle Row Holborn And also all that my Freehold Estate situate in Kinsland Road in the Parish of Saint Leonards Shoreditch And also all that my Freehold Messuage or Tenement situate in Denmark Street in the Parish of Saint Giles in the Fields And also all that my Freehold Estate situate in Saint Chads Row and Paradice in the Said Parish of Saint Pancras in the County of Middlesex in the Occupation of me the said Mary Gibbons subject to the payment of one hundred and fifty pounds to Richard Smart Esquire on his executing a conveyance thereof pursuant to an agreement made between him and my late Husband the said Thomas Gibbons And also all that my Copyhold Estate held under the Reverend Joseph Butler Clerk Lord of the Manor of the Prebendary of Islington otherwise Isleden in the County of Middlesex situate in the Parish of Saint Mary Islington now called or known by the name or description of Britannia Row together with two Messuages or Tenements adjoining Britannia Row aforesaid And also all that my Leasehold Estate situate lying and being in the Parish of Saint John Hackney in the said County of Middlesex now in the Tenure or Occupation of Mr Peter Duvall together with the Ground Rents arising out of and from five other houses adjoining to the said-------Peter Duvalls and also all that my Copyhold Estate consisting of seven eighth shares of and in one Messuage or Tenement and two Cottages and four Acres of Land situate lying and being in or near Stratford Bow and held under the Lords of the Manor of Stebunheath otherwise Stepney Manor in the Occupation of Elizabeth Watson Widow her Undertenants or Assigns And also all that my Copyhold Estate held under the Reverend Anthony Hamilton DD Prebendary of the Prebend of Cantlows otherwise Cantlow within the Cathedral Church of Saint Pauls London -- Lord of the said Manor situate lying and being at or near to Battle Bridge in the County of Middlesex aforesaid and now in the possession of me the said Mary Gibbons all which said Freehold and Copyhold Messuages Land Tenements heredits and premises hereinbefore mentioned I give devise and bequeath
Page 3 unto my good friends Mr Samuel Coney and Mr James Banner both of Battle Bridge in the Parish of Saint Pancras in the County of Middlesex and to the Survivor of them and to the heirs and Assigns of such Survivor To Hold all and singular the said Freehold and Copyhold Messuages Land Tenements Hereditaments and Premises unto the said Samuel Coney and James Banner and to the Survivor of them and to the heirs and Assigns of such Survivor for ever In Trust to and to the now ends intents and purposes hereinafter mentioned expressed and contained of and concerning the same (that is to say) In Trust in the first place that my said Trustees or the Survivor of them or the Heirs or Assigns of such Survivor do and shall pay and discharge all my just Debts and Funeral Expenses and then apply the Rents Issues and Profits arising and growing out of and from my said Freehold Messuage or Tenement situate in Little Turnstile Holborn and my said Freehold Messuage or Tenement situate in Princes Street New Turnstile Holborn aforesaid and my said Freehold Messuage or Tenement situate in Cursitor Street Chancery Lane aforesaid and my said Freehold Messuage or Tenement situate opposite Middle Row Holborn aforesaid to the payment of the Legacies so devised by the said last Will and Testament of my said Father in Law Thomas Gibbons or such parts thereof which shall remain unpaid at the time of my decease and to the payment of my just Debts and Funeral Expenses and then In Trust for my said Cousin Thomas Gibbons his Heirs and Assigns for ever subject to the payment of the said Sum of one hundred and fifty pounds as aforesaid And my further Will is that my said Trustees or the Survivor of them or the Heirs or Assigns of such Survivor shall and do permit and suffer my Brother in Law John Salter and my Sister Martha Salter to occupy possess and enjoy all that my Freehold Messuage or Tenement in Saint Chads Row in which I now dwell for and during the term of their natural lives and the life of the Survivor of them he the said John Salter and Martha Salter or one of them keeping the same in good and substantial repair during their lives and the life of the Survivor of them and after their decease them I give and bequeath the same to my said Cousin Thomas Gibbons and to his Heirs and Assigns forever And as to my other Freehold and Copyhold Messuages Lands Tenements Hereditaments and Premises I will and direct my said Trustees or the Survivor of them and the Heirs and Assigns of such Survivor to take and receive all and every the Rents Issues and Profits arising and growing due therefrom and pay and apply the same in discharge of the several Annuities hereinafter by this my Will devised that is to say One Annuity or yearly sum of one hundred pounds to my said Brother in Law and Sister John and Martha Salter aforesaid for and during the term of their natural lives and the life of the Survivor of _ And also
Page 4 the yearly sum of fifty pounds to the said Israel Gibbons for and during the term of his natural life only And the further Annuity or Yearly sum of fifty pounds to the said Guy Earl Warwick for his natural life only And also the further Annuity or Yearly sum of forty pounds to the said Hannah Oakman for and during the term of her natural life only and that the same shall not be under the control or subject to the Debts of her present husband or any other future husband she shall Intermarry with and that her Receipt from time to time for the same shall be a sufficient discharge to my said Trustees or the Survivor of them and the Heirs and Assigns of such Survivor notwithstanding her Covature And also the Further Annuity of Yearly sum of forty pounds to the said Ann Huttly for her natural life only subject to the same restrictions and powers as in the last above Annuity devised to the said Hannah Oakman And also one other Annuity or Yearly sum of twenty pounds to Charlotte the Daughter of the said John Salter for her natural life only subject to such restrictions and powers above mentioned And also the further Annuity or Yearly sum of twenty pounds to Martha Yeomans for her natural life only subject to such restrictions and powers as above mentioned And also the further Annuity or Yearly sum of twenty pounds to William Lancaster for and during the term of his natural life only all which said Annuities I will and direct to be paid Quarterly the first payment to begin and be made on the second Quarter Day which may happen after my decease And I further will and direct that when and as soon as all or any of the said Annuitants shall die that the Annuities so determining shall be paid to my said Cousin Thomas Gibbons as well as all such overplus of the Rents Issues and Profits arising from all and every the Estates hereinbefore devised by In Trust when he shall attain his Age of twenty two years And that when such Annuities shall cease I devise and bequeath all and singular the same Messuages Land Tenements Hereditaments and Premises so vested in Trust as aforesaid In Trust to and for the sole use of my said Cousin Thomas Gibbons and to his Heirs and Assigns for ever To hold the said Messuages Land Tenements Hereditaments and Premises to my said Trustees their Heirs and Assigns to the use of the said Thomas Gibbons his Heirs and Assigns for ever subject to such partition directions and conditions hereafter mentioned that is to say that my said Trustees or the Survivor of them and the Heirs and Assigns of such survivor shall and will permit and suffer the said John Salter and Martha his wife and the Survivor of them to take and hold the occupation use benefit and profits of the purging waters and the use of the Pump Room and Premises thereto belonging with Ingress Egress and Regress in and for the said John Salter and Martha his wife and the Survivor of them and all and every such person and persons who attend to drink the waters or others to use and walk around the Garden in the same and usual manner they were indulged with in my life time and that the said William Lancaster may be permitted to use occupy possess and enjoy and use and exercise all the Gardens belonging to and used as such and all the Roots Shrubs
Page 5 and trees therein and the Fish in the Ponds together with all and every the utensils belonging thereunto for his sole use and benefit and also free liberty of Ingress Egress and Regress to the Pump Room and also the use of the Brewhouse and Garretts in the Wells House for drying and keeping the same together with the use of the Drawers in the Pump Room in the same manner as my late husband used the same for and during the term of his natural life and then In Trust to fall into the general Trusts of the several Estates hereby vested by me as aforesaid To and to the use of my said Cousin Thomas Gibbons his Heirs and Assigns for ever I also give devise and bequeath to my said Cousin Thomas Gibbons my late Father in Laws Gold Watch and Chain and also a Clustered Diamond Ring of his and the Mahogany Bureau Book Case in the Parlour and all the Books of what kind soever together with all my late Husbands wearing Apparel --------------------------------------------------------------------I also give to the said William Lancaster the Bed and Bedstead with Check Furniture compleat in the two pair of Stairs front Room and six Walnuttree Chairs with green bottoms and the Wainscott Bureau in the Lobbe I also direct my said Trustees or the Survivor of them after my decease to pay to the Trustees of the Charity School in the Parish of Saint Pancras in the County of Middlesex the sum of ten pounds a year for ever And all the rest residue and remainder of my household Goods Plate Linen China and my wearing Apparel I give to my Sister Martha Salter And whereas my Cousin John Morris stands in debted to me in the sum of one hundred and fifty pounds upon Mortgage on Premises in Paradice Street and Court in the Parish of Saint Pancras aforesaid I do hereby remit and forgive him the same and devise the same to him accordingly And as to my said Leasehold Messuage or Tenement and Premises situate in Church Passage in Islington in the tenure or occupation of John Gwyn I give and devise the same to my said Trustees and the Survivor of them and the Executors and Administrators of such Survivor In Trust to hold the same for all the rest and residue of the term of years to come at the time of my decease to and for the sole use and benefit of the said Thomas Gibbons subject to the Rent and Performance of the Covenants which on the Tenant or Lessees part are or ought to be paid and performed And I do hereby nominate constitute and appoint my said Trustees Mr Samuel Coney and Mr James Banner and my said Cousin Thomas Gibbons Executors to this my Will hereby revoking all former Wills by me at any time heretofore made and do hereby direct that my said Trustees their Heirs Executors Administrators or Assigns shall be accountable only for so much monies and Effects as shall actually come into their hands and shall not be accountable or answerable for any insufficiency or deficiency in any of the Trust Estate or any part thereof that shall be vested in them and that they shall or may retain in his or their hands all such Costs Damages and Expenses which may attend the execution of the Trusts by this my Will created out of the Estate and Effects in them vested by this my Will And I do hereby give and devise to my said Trustees

Impey Inner Temple William Tidd ---- James Hall 22 December 1781 On which day appeared personally William Lancaster of the Parish of Saint Pancras in the County of Middlesex Gentleman and made Oath that the last Will and Testament of Mary Gibbons late of the Parish of Saint Pancras aforesaid Widow deceased which bears date the third day of December Instant and is hereunto annexed is wrote by this Deponents own hand and that he this Deponent was present at the execution of the said Will and that before the same was executed the obliteration in the twenty fifth line of the first Sheet and the obliterations in the ninth and eleventh lines of the third Sheet of the said Will were first made and the said Will is now in the same plight and condition as when the same was executed by the said Testatrix Wm Lancaster - Same day the said William Lancaster was only sworn to the truth of this Affidavit before me And: Coltee Ducarel Surrogate present Roger Altham Not. This Will was proved at London the Twenty ninthday of December in the year of our Lord one thousand seven hundred and eighty one before the Worshipful Andrew Coltee Ducarel Doctor of Laws Surrogate of the Right Worshipful Peter Calvert Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the oath of Samuel Coney and James Banner two of the Executors named in the said Will to whom Administration was granted of all and singular the Goods Chattels and Credits of the deceased they having been first sworn duly to Administer power reserved of making the like grant to Thomas Gibbons the other Executor named in the said Will when he shall apply for the same |
